The Judicial Appointments Commission (JAC) is now inviting applications for the posts of:
Fee-paid Medical Member of the First-tier Tribunal, Health Education and Social Care Chamber, Mental Health, and Fee-paid Medical Member of the Mental Health Review Tribunal for Wales.
Number of vacancies: Up to 50 for Fee-paid Medical Member of the First-tier Tribunal, Health Education and Social Care Chamber, Mental Health (HESC); and up to 10 for Fee-paid Medical Member of the Mental Health Review Tribunal for Wales (MHRT Wales).

Location: HESC covers England only and MHRT covers Wales only.
Salary: HESC: £469 per day plus £177.50 per patient examined.
MHRT Wales: £469 per day plus £174 per patient examined.
The HESC chamber and MHRT Wales are responsible for deciding upon the necessity for the continued compulsory detention of mentally disordered patients in hospital or the continuation of a conditional discharge, guardianship, or a community treatment order.
The powers of the Tribunal are significant, with a responsibility to balance the liberty of the subject with potentially serious risk to the patient, their families and the public. Their powers and duties are set out in the Mental Health Act 1983.
The Tribunals cover the whole of England and Wales. Tribunal hearings, which consist of a judge, a medical member and a specialist lay member, are usually held in private and most will take place in hospitals. You will be required to draw upon your clinical knowledge and apply your analytical skills in order to assess evidence. In this capacity you may also be required to examine the patient prior to the hearing.
It is normal practice when selecting members to sit on the tribunal to try, as far as possible, to select members who live within reasonable distance of the hospital where the hearing is to take place. It is, however, often necessary to ask members to travel to more distant hospitals.
Please note that if you apply for both positions you could potentially be appointed to both positions. You will be expected to dedicate a minimum of 20 days a year per role to Tribunal business.

To be considered for appointment you must meet the eligibility requirements. As we will not be assessing eligibility until the shortlisting stage, it is your responsibility, and in your own interest, to ensure that you meet the eligibility requirements before submitting an application.
To be eligible for appointment as a Fee-paid Medical Member you must be a registered medical practitioner.
“Registered medical practitioner” means a fully registered person within the meaning of the Medical Act 1983 whether or not they hold a licence to practise under the Act.
Registration must be with the General Medical Council (GMC) in the UK.
Additional Selection Criteria
The Lord Chancellor also requires that candidates’ registration with the GMC must be unconditional.
Conditional registration is where the doctor has either been issued with a warning or has been referred to a Fitness to Practice Panel or has any restrictions imposed upon their registration with the GMC.
In addition to the above, candidates must have held a full-time or part-time appointment as a consultant psychiatrist for at least three years one of which should normally be within the last five years; and have membership of the Royal College of Psychiatrists at any of the following levels:
c) Specialist associate.
Candidates must be either a UK Citizen or a Citizen of the Commonwealth or the Republic of Ireland at the time of application.
There is no upper or lower age limit for candidates apart from the statutory retirement age of 70. However, the age at which someone is appointed as Fee-paid Medical Member must allow for a reasonable length of service before retirement, usually for HESC it is five years and for MHRT Wales it is three years.
The Commission will make the decision as to whether a candidate will be able to provide a reasonable length of service.

Referees are approached before the selection day takes place and the evidence they provide will inform decisions during the selection process. References will be requested on 15 March 2016 and must be returned by 29 March 2016. Late references may not be considered, therefore you are advised to notify your referees in advance that you intend to apply.

If you are shortlisted, you will be invited to attend a selection day in either London, Leeds or Manchester between 11 April and 21 April 2016. The selection day for this exercise will comprise a role-play and panel interview where the selection panel will be seeking evidence from you against all the competencies for the post. Equal merit provision
In line with its published policy, the Commission will apply the equal merit provision to this exercise. If the Commission, sitting as the Selection and Character Committee, considers two or more candidates to be of equal merit, a candidate may be selected for the purpose of increasing judicial diversity. The Committee will use the provision based on the data declared by candidates in the diversity part of their online application.
The relevant datasets that will be used to identify any under-representation are taken from the 2011 Census, detailed Characteristics, England and Wales (ONS 2012) and the diversity statistics showing the background of the First-tier fee-paid judiciary (as of 1 April 2015), based upon primary appointment, as published on the Judiciary website.
The population of the United Kingdom ('usual residents') aged 25-74 that are women is 50.4%, while BAME is 11.3%. The proportion of First-tier tribunal that are women is 45% and of those who declared their ethnicity 15% declared they were from a BAME background.

The Selection and Character Committee will consider which candidates to recommend to the Appropriate Authority as set out in the Judicial Appointment Regulations 2013.
For this exercise the Appropriate Authority for MHRT Wales will be the Lord Chancellor who will consult with Welsh Ministers. For HESC the Appropriate Authority will be the Senior President of Tribunals. The Appropriate Authority can accept or reject a recommendation, or ask the Commission to reconsider. The Appropriate Authority may not select an alternative candidate.
When considering the candidates to recommend for appointment, the Commission will consider all the information gathered, which includes the overall assessment report from the selection panel. For MHRT Wales the Commission will also consider statutory consultation comments.
Outcome of the exercise
Please note that we will issue results by email to all those interviewed at the same time. We hope this will be by end July 2016.
If you are not successful following the selection day, you can request written feedback. You should make this request within six weeks of the email informing you that you have not been successful. We will aim to respond to your request within six weeks.
