Candidates are selected for current vacancies under Section 87 of the Constitutional Reform Act and for vacancies that may arise in the foreseeable future under Section 94.
The Ministry of Justice can ask the JAC to run exercises under Section 87, under Section 94, or as a combination of both.
Section 94 lists
Candidates selected under Section 94 will be placed on a list.
When you are on a Section 94 list, it is important to inform us of changes to your location preferences or working patterns, as this may affect recommendations we are asked to make. Please email updates to the JAC team who dealt with the original exercise.
However, being placed on the list does not guarantee a post, as business needs may change. Candidates are therefore advised not to make plans to take up appointment when you are placed on a list.
Being on a list does not stop you applying for another exercise, as applications for different exercises are treated separately.
Being ‘called-off’ (appointed from) a list
The JAC will write to inform you that you have been recommended for an immediate appointment and it has been accepted by the Appropriate Authority.
You will be called for a deployment interview with HMCTS to discuss the vacancy and will normally be expected to take up the appointment within 6 months of the offer.
List reviews and closure
Section 94 lists could be reviewed and closed at any time depending on business needs and forthcoming exercises. No list will remain open for more than 2 years.
After this length of time, there may be a wider pool of eligible candidates and we could no longer be confident of fulfilling our statutory duty to recommend the most meritorious candidates by relying solely on a previous Section 94 list.
If a list is due to close and a new exercise launches, you will have to reapply. However, before it launches, the Commission will decide on the process for candidates still on the list.
We will write to these candidates with details of how to reapply and the process for call-offs from the list while the new exercise is in progress.
When new vacancies arise, we send a notification to all candidates on the Section 94 list advising them of the vacancies and requesting updated location and salaried part-time working preferences.
