The role

A Resident Judge will be expected to sit at least 50% of the time in the First-tier Tribunal, Immigration and Asylum Chamber, either alone or in developmental panels hearing substantive and more complex appeals. A Resident Judge is the principal at their assigned Regional Hearing Centre and will work closely with any Designated Judge/Assistant Resident Judge in post in their region.

In addition to sitting as a judge, the Resident Judge exercises a delegated responsibility from the President for the allocation of cases to Immigration Judges in the Region.  The main activities of a Resident Judge include:

  • Case Management
  • Liaison with Administration
  • Liaison with Stakeholders

Who can apply

In order to be considered for appointment for this post, you must meet the following eligibility requirements. As we will not be assessing eligibility until after the shortlisting stage, it is your responsibility, and in your own interest, to ensure that you meet the eligibility requirements before submitting an application.

Statutory Eligibility

Judges of the First-tier Tribunal are appointed by the Senior President of Tribunals under paragraph 1 of Schedule 2 to the Tribunals. Courts and Enforcement (TCE) Act 2007, further amended by Schedule 13 to the Crime and Courts Act 2013 a person is eligible for appointment as a judge of the First-tier Tribunal if the person:

(a) satisfies the judicial-appointment eligibility condition on a 5-year basis;

(b) is an advocate or solicitor in Scotland of at least five years' standing;

(c) is a barrister or solicitor in Northern Ireland of at least five years standing, or

(d) in the opinion of the Senior President of Tribunals, has gained experience in law which makes the person as suitable for appointment as if the person satisfied any of paragraphs (a) to (c)

The TCE Act 2007 introduced the ‘judicial-appointment eligibility condition’. You will have to show that:

  • you have possessed a relevant legal qualification;
  • for the requisite period; and
  • that whilst holding that qualification you have been gaining legal experience

The meaning of “gain experience in the law” is set out in section 52(2) to (5) of the TCE Act and relates to a period engaged in law related activities.Relevant qualification” means a solicitor, a barrister or a Fellow of the Chartered Institute of Legal Executives.

Additional Selection Criteria

The Lord Chancellor expects that candidates for salaried posts will have sufficient directly relevant previous judicial experience. Only in exceptional cases and if the candidate in question has demonstrated the necessary skills in some other significant way should an exception be made. The meaning of "directly relevant experience" is sitting as judge in a salaried or fee-paid capacity. For fee-paid judges at the point of application, the length of directly relevant previous judicial experience should be a minimum 30 completed sitting days, not including days taken for training purposes or sickness, since appointment in a fee paid capacity.


Candidates must be a citizen of the United Kingdom, the Republic of Ireland or a citizen of a Commonwealth country at the time of application.  Candidates who hold dual nationality, one of which falls into one of these categories, are also eligible. Other European Union citizens are not eligible to apply.


There is no upper or lower age limit for candidates apart from the statutory retirement age of 70. However, the age at which someone is appointed as a judicial officer must allow for a reasonable length of service before retirement, usually for these posts it is five years.

The Commission will make the decision as to whether a candidate will be able to provide a reasonable length of service.
