Chief Justice of the Falkland Islands

Applications are invited to fill the post of Chief Justice of the Supreme Court to the Falkland Islands which will fall vacant in February 2018.

The Chief Justice presides over the Islands’ Supreme Court, which has unlimited civil and criminal jurisdiction at first instance, and in addition hears both civil and criminal appeals from the Senior Magistrate, who is the resident judge in the Falkland Islands, and the Summary Court. While the majority of the work originates in the Falkland Islands jurisdiction, the post holder will also be concurrently the Chief Justice of South Georgia and the South Sandwich Islands, the British Antarctic Territory and the British Indian Ocean Territory.

The post itself is non-resident and part-time, however the office holder will be required to visit the Falkland Islands periodically as and when required. (In the past this has been for two visits per year, each of approximately two weeks, but recent trends suggest that more frequent visits may be necessary in the future). The post holder should also expect to spend additional days per annum dealing with ex parte, interlocutory and executive work which will not normally require a presence in the Islands.

Candidates should be able to demonstrate:

  • Significant judicial experience (salary or fee paid);
  • At least 10 years post admission experience as a barrister, solicitor or advocate in the UK or a Commonwealth jurisdiction or the Republic of Ireland;
  • Extensive experience of both civil and criminal work of importance and complexity, and the ability to deal with complex cases in a less familiar jurisdiction.

Emoluments will be based on the Ministry of Justice Judicial Fees (Circuit Judge) currently £642.10 per day.
